Vine, Inc. d/b/a Vyn (hereafter referred to as “we” or “us” or “our”) cares about privacy. You (hereafter referred to as “you” or “your” or “yourself”), as a person who voluntarily visits our website or uses our mobile application, are subject to our Terms of Use and Privacy Policy.

We do not sell or trade your information. However, we do collect certain information in order for you to use the Vyn app. This Privacy Policy explains how we collect data, use data, disclose data, and safely store data gathered when you visit our mobile application (hereafter referred to as “App”) or our website www.vyn.app (hereafter referred to as “Website”). Please read our Privacy Policy in full, which we reserve the right to change at any time for any reason. Our App and Website contain links to our most up-to-date Privacy Policy, which will state the date we last updated it. Using the Vyn App means you accept our current Privacy Policy. If you do not agree to our Privacy Policy, please refrain from using our App. We encourage you to link to our Privacy Policy each and every time you visit our Website or use our App to check for any updates. It is your responsibility to read thru any updates to our Privacy Policy as continued use of our App means you are bound by and accept our most recent Privacy Policy. By downloading, accessing and/or using our App and Website, or interacting with individuals via the App, you agree to the collection and use of your information in accordance with this Privacy Policy.

Please note that our company is based in the United States of America and our Privacy Policy, as well as our Terms of Use, are based on US standards. If you don’t agree with either our Privacy Policy or our Terms of Use, please delete your User Account/Profile on our App and then delete the App from your device. If you have questions about this process or require assistance, you may contact us thru our App or Website.

This Privacy Policy applies to our App and Website. It does not apply to any third-party website or online or mobile store from which you learned about or installed our App nor any third party involved in the processing or facilitating of payments. Such third parties, which may also collect and use data about you, will have their own Privacy Policy; you should familiarize yourself with their Terms of Use and Privacy Policy. We are not responsible for data collected by any such third party nor the manner in which they collect, use, disclose, or store that data. Each time you visit our Website and use our App, you accept that we are not responsible for third-party data collection, use, disclosure, or storage as well as any breach of same.

Collection and Storage of Your Information

Personal Data

We collect and store information shared with us during the sign-up process of creating a User Account or Profile as well as when generating any type of posting on our App. Examples of such reasons include but are not limited to promoting yourself via our App to get hired for a modeling stint (hereafter referred to as “gig”), to list property or things for rent on our App, to browse content on the App, to hire people or rent things via our App, to pay someone you hired for a gig via our App, to pay someone for something you rented via our App, or for you to get paid if you were hired for a gig or offered something for rent via our App.

Below follows a list of information we may collect when you use our App. This list is not exhaustive but is intended to illustrate the key types of data we collect. Some data will be made publicly visible to others using our App while other data will be shared only with third parties involved in a specific transaction or the processing of a payment. Data you share with us that will be made visible to the public is listed below and proceeded by an asterisk(*). All other types of data listed below but not proceeded by an asterisk may be collected and shared with certain third parties as deemed necessary for transactions or payment processing. In other words, this data is neither private nor made visible to everyone; this data is shared as deemed necessary. If you have questions about the specific use of any data, which will be dependent on your transactions using our App, please contact us and we will be happy to answer them.

Images

You may upload images while using our App. Such images include but are not limited to User Profile images and posting images; examples include images of either yourself or your equipment, vehicles, or locations available for someone to rent for photography shoots and filming. All images you upload via our App should not be considered private in that they will be visible to the public. If you wish to keep an image private, do not upload it to the App. By uploading any image to the App, you acknowledge and understand that your image can be viewed, printed, or copied by the public and we have no control over how the public may share, disseminate, or reuse that image. When you upload an image to our App, you are effectively asking us to publicly display that image and shall hold us harmless concerning who views the image, who copies or prints the image, or how that image may be disseminated, altered, or reused by anyone other than us.²

How We Use Your Data

At present, our Website and App do not advertise or market anything utilizing your personally identifiable information, nor do we use cookies. However, there are many other ways in which we may utilize the data you voluntarily share with us.

Verification

We may use your personal information to verify your identity or authenticate information you provide when signing up or signing in to create or edit a User Account / Profile as well as during the payment process, collection of fees, or when resetting passwords.

Troubleshooting and Dispute Resolution

We may review your information to detect violations of our Terms of Use, to prevent abuse, to troubleshoot issues, to provide customer service or other assistance to you or our other Users, and to aid us in mitigating problems or attempting to resolve disputes.

Statistical Analysis

Each time you visit our Website or App, we collect data about how you interact with them. We may collect information that helps us learn about you and how you utilize our Website and App for a number of statistical and analytical purposes, including ongoing research that allows us to optimize the Website or App to enhance your experience. Such data is solely for our internal use and relegated to understanding our Users to improve our Website and App.

Geolocation Data

Our App will ask for your geolocation when you Check-in for a gig. The purpose of Check-in is to tell the App you have arrived at the gig location on time. When you initiate Check-in, you have the choice of granting the App access to your current geolocation or denying this information. Such information reveals your approximate location when you show up for a gig. We collect the address information, which may be exact or approximate.³

App Notifications

During the App registration process, you will be asked whether you wish to receive notifications from us or not. Examples of notifications include but are not limited to being informed that you have received an offer for a gig (or that someone wants to rent your equipment, vehicle, or location) or that an individual has accepted your offer for a gig (or that someone has agreed to your request to rent their equipment, vehicle, or location) for a photography or filming shoot.

Data Retention and Deletion

You may delete your User Account/Profile at any time provided that there are no incomplete/pending transactions/payments. Deleting your Account/Profile will delete data we store about you; however, it will not delete third party data. We take no responsibility for data collected or stored by third parties; you will need to contact any third parties directly with questions about the data they collect and store.

Misuse of our App

Should any User violate our Terms of Use, we reserve the right to immediately remove some or all data as we deem necessary, as well as delete the violating User Account / Profile and permanently ban the User from our App. If you become aware that your personally identifiable information was uploaded to our App by another party in violation of our Terms of Use, you should immediately notify us so we may immediately remove this information from our App.

Special Protection of Minor Children

As noted in our Terms of Use, We expressly forbid anyone under the age of 18 from using our App. We would never knowingly collect personal information from Users under the age of 18. If we become aware that a child has used our App or that personal information or images pertaining to a child were uploaded to our App in violation of our Terms of Use, we shall immediately remove the offending data as well as the User Account (and we will permanently ban the User from our App). If you are the parent or guardian of a minor who has violated our Terms of Use or whose personally identifiable information was uploaded by another party in violation of our Terms of Use, you should immediately notify us so we may remove this information from our App. We do not tolerate violations of our Terms of Use and, more importantly, always strive to safeguard minors from harm whether at their own hand or that of another with respect to the use of their personal information. Should we discover any malicious or otherwise illegal disclosure of a minor’s information, we reserve the right to share any and all pertinent data concerning the event with law enforcement or other authorities. We also reserve the right to take any and all legal actions against those who misuse our App to harm minor children.

Prevention of Sexual Misconduct and Human Trafficking

As noted in our Terms of Use, We expressly forbid the misuse of our App to promote any criminal activity, including but not limited to sexual misconduct and human trafficking. If we become aware that a User Account / Profile was created under false intent for the stealth purposes of attempting to promote or engage in sexual misconduct or human trafficking of oneself or another individual in violation of our Terms of Use, we shall immediately remove any offending data from public view as well as the User Account / Profile (and we will permanently ban the User from our App); the same holds for any User who attempts to hire a model for a gig via our App under false pretense with hidden intent to use that person in human trafficking whether willingly or unwillingly. If you become aware that your personally identifiable information was uploaded by another party in violation of our Terms of Use, you should immediately notify us so we may immediately remove this information from our App. We do not tolerate violations of our Terms of Use and, more importantly, always strive to safeguard individuals from harm whether at their own hand or that of another with respect to the use of their personal information. Should we discover any malicious or otherwise illegal attempts to misuse our App as part of an illicit scheme to promote human trafficking, we reserve the right to share any and all pertinent information concerning the event with law enforcement or other authorities. We also reserve the right to take any and all legal actions against those who misuse our App to harm individuals.

Sharing

The purpose of our App is to connect people available for hire or who own things they would like to rent for a photography or filming shoot with those who need them. To that end, certain information you voluntarily provide must be exchanged with those parties to facilitate basic communication and needed information prior to the gig. If someone offers you a gig, it is reasonable to expect that your name and phone number will be shared with that person and vice versa. The same holds true if you rent equipment, a vehicle, or a location to someone for their photography or filming shoot. In some instances, such as renting a vehicle, you may be asked to provide us with an image of your driver’s license which we may share with the owner of the vehicle you wish to rent. In addition, you may be on the giving or receiving end of a payment processed via our App; currently, we use Apple Pay to process your payments. We must provide your personal information to our payment processors. We may also share your personal information if legally compelled or to protect the rights, property, or safety of our Users or others including the preservation of our own interests.

We may also create aggregated and de-identified data from your personal information, rendering it into anonymous data that can not be attributed to you, for our research purposes and reserve the right to share it with third parties for our business purposes.

We may also share your information with our service providers if necessary to enable them to provide services to us regarding the maintenance or security of our Website and App.

Security

We take appropriate measures to protect your data from unauthorized access, loss, and being misused. Additionally, third parties who process your personal information on our behalf, including but not limited to providing your geolocation or processing a payment, take their own security measures to help protect and secure your data. However, it is simply not possible for us or third parties to guarantee the absolute security of your personal information either online and offline; the internet landscape is not without inherent risks and ever changing challenges to the security of personal information.

If you do not want to assume any risks regarding your personal data by using our App on your device over the internet, you should delete your User Account on our App and delete the App from your device.

Retention

We keep your information while your User Account is active or as deemed necessary in accordance with our legal obligations or as otherwise described in our Privacy Policy.

Storage Location

We store all our App information on Google servers.

Please note that examples of such data include information you voluntarily enter regarding your gender, year of birth, hair color, eye color, body measurements, and shoe size that we gather with the intent of helping models get matched with potential gigs where appearance or clothing/shoe size may be directly relevant per industry demands. For example, a fashion show director might be searching for models that will fit their runway clothing. Such information that you provide is not intended to promote discriminatory practices on the basis of gender, age, appearance, or size as we do not tolerate discrimination of any kind.
We wish to add here that we do not own any images you upload to our App, we simply display your images to the public via our App after you have uploaded them. In accordance with our Terms of Use, you should only upload images of yourself and for which you alone have sole ownership rights; this extends to the use of names and logos, meaning you should not display names and logos which are not your own. When you upload an image to our App, you are effectively claiming to own the exclusive rights to that image and any intellectual property displayed therein. To that end, you alone are responsible for any misuse of copyrighted content that you do not own the sole rights to but have voluntarily upload to our App in violation of our Terms of Use. In such instances, you and not us shall be held responsible for any privacy violations or intellectual property claims regarding the improper display or use of an image or logo you do not own arising from your having uploaded them to our App for public display. Remember, you agree to assume all risks when you upload an image to our App as your own. We cannot guarantee that the public will not violate our Terms of Use and find ways to print or otherwise reproduce your image without your or our consent. While we do not condone such actions and abhor any misuse of a User image, we simply cannot guarantee that your images will not be printed, copied, reproduced, or shared (with or without alteration) anyplace other than our App; further, you agree to hold us harmless from the same.
Understand that if you choose to deny revealing your geolocation when checking-in for a gig, you will not be able to use the Check-in feature on the App. If you do not Check-in for a gig, we will rely solely on information we receive from the hiring party to confirm whether or not you arrived on time for the gig and fulfilled some or all of your hours; this could delay your receiving payment or otherwise impact whether you get paid in part or full. In fact, failure to Check-in means the hiring party may opt to cancel your gig altogether and, in such a case, you would not get paid.
